Welcome to Lunar Racks, LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, services, and products, including game server hosting, VPS hosting, shared web hosting, voice services (e.g., Mumble/TeamSpeak), and billing (collectively, the “Services”). By accessing or using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old or have legal capacity to enter into contracts. You represent that all information provided during registration is accurate and complete.

2. Services Description

Game Server Hosting: We provide dedicated instances for games like Minecraft, ARK: Survival Ascended, Rust, and others. Features include mod support, backups, and DDoS protection. Resources (e.g., CPU, RAM) are allocated per package; overuse may lead to suspension.
VPS Hosting: Offering KVM-based virtual servers with root access, OS templates, and scalable resources. Suitable for custom setups, but you are responsible for software management unless opting for managed services.
Shared Web Hosting: Including unlimited bandwidth (fair use), email accounts, and Softaculous for one-click installs. Overselling is not permitted on your end if reselling.
Voice Services: Hosting for Mumble/TeamSpeak with slot-based plans, integrated for low-latency communication alongside game servers.
Billing and Management: All Services are managed for invoicing, tickets, and client areas. We reserve the right to update features or pricing with 30 days’ notice.

3. Account and Security

You must create an account to use the Services. Maintain the confidentiality of your credentials. Notify us immediately of unauthorized access. We are not liable for losses due to compromised accounts.

4. Acceptable Use Policy (AUP)

You agree not to use the Services for:

Illegal activities, including piracy, hacking, fraud, or violation of any applicable law.
Spamming, phishing, malware distribution, or denial-of-service attacks.
High-risk content (e.g., adult material without proper verification, unlicensed gambling).
Resource abuse (e.g., cryptocurrency mining without approval, excessive bandwidth consumption).
Gaming-specific: Custom mods and plugins are allowed, provided they do not violate the game’s terms of service or enable cheats/exploits that harm fair play or server integrity.

Violations may result in immediate suspension or termination without refund. We monitor for abuse but respect privacy.

5. Payments and Billing

Services are billed monthly, quarterly, or annually.
Accepted payment methods: Stripe and PayPal.
Auto-renewals are enabled by default; you may opt out via your account.
Invoices are due upon receipt. A 5-day grace period applies before late fees of 10% (minimum $2.00) are assessed.
Pricing is as listed on our site; we may adjust with 30 days’ notice.
Refunds: 30-day money-back guarantee for new services (excluding setup fees). No refunds on renewals more than 5 days past due date. Prorated refunds may apply for cancellations, at our discretion.

6. Uptime and Maintenance

We provide a 99.99% uptime guarantee, as detailed in our separate Service Level Agreement (SLA). Credits will be issued for downtime exceeding this threshold. Scheduled maintenance will be announced 24 hours in advance. Downtime due to abuse or external factors is not covered.

7. Data and Backups

You own your data. We provide backups as per package (e.g., 1-3 for games via Orbit Command). However, you are responsible for your own backups. We are not liable for data loss. For web hosting (cPanel), use built-in tools; for VPS (Nebula Core), snapshots are available.

8. Intellectual Property

You grant us a license to host your content. Do not infringe third-party IP (e.g., no unauthorized mods in Orbit Command). We comply with DMCA notices and will forward valid complaints to you.

9. Limitation of Liability

To the fullest extent permitted by law, Lunar Racks, LLC is not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss). Liability is limited to the amount paid for the affected Service in the last 12 months. Services are provided “as is” without warranties.

10. Termination

We may terminate or suspend Services for violations of these Terms, non-payment (after grace period), abuse reports, hacking, using our systems for attacks (e.g., DDoS), or at our discretion with 7 days’ notice. Upon termination, access ends, and data may be deleted after 30 days. You may cancel via My Rack with prorated refunds where applicable.

11. Governing Law

These Terms are governed by the laws of Florida, United States, without regard to conflict of laws principles. Disputes shall be resolved in the courts of Hillsborough County, Florida.

12. Changes to Terms

We may update these Terms with 30 days’ notice via email or site announcement. Continued use constitutes acceptance.
